Terms of Service

Agreement

By creating a guideOS account or using the platform, you agree to these Terms of Service. If you are using guideOS on behalf of a business, you represent that you have authority to bind that business to these terms. These terms form a contract between you and guideOS.

The service

guideOS provides a web-based and mobile-accessible platform for fishing guides to manage bookings, clients, payments, schedules, trip reports, and client communications. The features available to you depend on your subscription plan.

We reserve the right to modify, add, or remove features at any time. When we make significant changes, we will notify active subscribers in advance. We aim to improve the product, not diminish it.

Your account

You are responsible for maintaining the security of your account credentials. Do not share your password. You are responsible for all activity that occurs under your account. If you believe your account has been compromised, notify us immediately at [email protected].

You must provide accurate information when creating your account. Accounts created with false information may be terminated.

Acceptable use

You may use guideOS for lawful business purposes related to operating a fishing guide or charter service. You agree not to:

• Use the platform to conduct fraudulent transactions or collect payments for services you do not intend to provide.
• Send spam, unsolicited communications, or communications that violate applicable law through guideOS messaging features.
• Attempt to access other guides' accounts or data.
• Reverse-engineer, scrape, or otherwise extract guideOS data or functionality in unauthorized ways.
• Use guideOS to operate any business other than a licensed fishing guide or charter operation.

Subscriptions and billing

guideOS is offered on a monthly subscription basis at $75/month, billed at the beginning of each billing cycle. New accounts receive two full months of access at no charge. No credit card is required during the free period.

After the free period, your payment method will be charged automatically at the start of each billing cycle. Prices are in USD. We will provide at least 30 days' notice before increasing subscription prices.

Subscriptions renew automatically until cancelled. You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period. We do not offer prorated refunds for partial months.

Your data

You own the data you enter into guideOS, including your client list, booking records, trip reports, and business configuration. guideOS processes that data to operate the platform on your behalf. See our Privacy Policy for full details on data handling.

You may export your data at any time. If your account is cancelled or terminated, you have 30 days to export your data before it is deleted from our systems.

Payment processing

guideOS integrates with Stripe for payment collection. When you connect a Stripe account, you also agree to Stripe's Terms of Service. guideOS is not responsible for payment disputes, chargebacks, or errors originating with Stripe or your clients' financial institutions.

Uptime and availability

We aim to keep guideOS available and operational. We do not guarantee 100% uptime. Planned maintenance will be communicated in advance when possible. We are not liable for losses caused by service interruptions outside our reasonable control, including third-party outages affecting weather data, tide data, or payment processing.

Intellectual property

guideOS, including its design, code, and features, is owned by us and protected by intellectual property law. Your content, including client records, trip reports, and photos, remains yours. By uploading content to guideOS, you grant us a limited license to store and process it for the purpose of operating the platform.

Limitation of liability

guideOS is a business management tool, not a licensed financial advisor, legal counsel, or maritime safety system. Decisions about whether to run a trip, collect a payment, or communicate with a client are yours. We are not liable for business losses, missed bookings, weather-related trip cancellations, or client disputes arising from your use of the platform.

To the maximum extent permitted by law, guideOS's total liability to you for any claim arising from use of the platform is limited to the amount you paid us in the three months preceding the claim.

Termination

You may close your account at any time. We may suspend or terminate accounts that violate these terms, following reasonable notice where the violation is curable. In cases of fraud, illegal activity, or serious security risk, we may terminate immediately.

Governing law

These terms are governed by the laws of the United States and the state in which guideOS is incorporated, without regard to conflict-of-law principles.

Changes to these terms

We may update these terms as the product and our legal obligations evolve. We will notify you by email at least 14 days before material changes take effect. Continued use of guideOS after that date means you accept the updated terms.
